Phrasing of GATS V: Implications for the Architecture of International Trade Law

In this workshop, doctoral students of Prof. Cottier, Prof. Oesch and Prof. Panizzon had the chance to present parts of their work and discuss them with supervisors and other students. The workshop took place in Bern 25-26 February 2011. This presentation analyses GATS V from the perspective of a developing country and discusses whether or not GATS V is successful in promoting sustainable economic development through economic integration in the South, while at the same time preventing trade diversion. Given the well-known difficulties of legal interpretation and enforcement in international trade law, the presentation also discussed the implication of GATS V’s weaknesses for the logic of the international trade system and WTO-law.
