Abstract

This paper aims to give an overview of current legal rules regarding the patentability of inventions in the field of animal genetics. It focusses in particular on product patentability in Canada, the United States and the EPO-zone. Furthermore, it addresses certain specific issues in relation to animal-patentability and accords special attention to the ordre public and morality exception. Finally, it looks at the invention v. discovery-criterium as discussed in jurisprudence on the patentability of animal genetic invention specifically and also looks at economic argument made in relation thereto.
