Abstract The paper brings a comparison of the North American and European approaches towards the liberalization of foreign trade investment (FDI) as these approaches are reflected within international investment agreements. The paper analyses both the US and European bilateral investment treaties as well as the North American Free Trade Agreement in more details and it addresses their make-or-break issues in the liberalization of FDI in exact terms. Authors also analyse the process of the liberalization of FDI in the World Trade Organization framework, when they focus on the Agreement of Trade-Related Investment Measures and the General Agreement on Trade in Services. Finally, the paper presents and discusses some of the most challenging issues for concluding the General Agreement on Investment.
