Chaisse Julien, Chakraborty Debashis and Raju K.D., ‘Growing Misuse of Anti-Dumping Provisions - Analysing some Pertinent Concerns’, NCCR Working Paper No. 30, August 2007.
Abstract
The purpose of the WTO Agreement on Anti-Dumping is to ensure that the provision is used only as a contingency measure based upon merit, and not as a veiled protectionist mechanism. However, since the establishment of the WTO in 1995, the number of anti-dumping investigations initiated has increased substantially. Given the growing misuse of anti-dumping investigations, there is an urgent need to look into the modification of the procedure, and the current analysis attempts to identify the broad areas of violation of the Agreement on Anti-Dumping in world trade and subsequently discusses the potential provisions for future reform.
